11/15/11 City Attorney Nelson Chipman presented an ordinance to amend the salary ordinance for this year and next by designating the Recreation Director/Pool Director position as an hourly position instead of the salaried position it’s been during Monday night’s common council meeting.
The Statement of Intent spells out an hourly rate of $14.47 hourly for 2011 and $14.90 hourly for 2012.
The Fair Labor Standards Act imposes upon employers continuing duty to assess the exempt or non-exempt status of employment positions with the city. After careful review of the three tests determining a job administratively exempt, the Recreation/Pool Director only met the salary requirements. Based upon principals of internal equity, it is recommended an appropriate maximum hourly rate of pay should not exceed that of the officer manager in the same department.
A motion was made to suspend the rules and pass the ordinance amendment on all three reading Monday night died as Councilman Mike Delp voted against suspending the rules. (To suspend the rules, it must be unanimously approved.) The ordinance amendment was heard on first reading and can be voted on for 2nd and 3rd reading at the November 28th meeting.
