01/07/11 The Marshall County Commissioner heard good news from the County Attorney on two litigation issues.

The County’s liability insurance carrier notified Jim Clevenger that the federal court has dismissed a case that stemmed from an incident at the old jail in 2006. The inmate alleged that he had been assaulted at the jail.  He said he was placed in a cell with other inmates that deputies knew would assault him.  He filed suit against Sheriff Jon VanVactor and numerous deputies.

The Federal Court Judgment issued is 32 pages long.

The second item of litigation involved a case before the Equal Employment Opportunity Commission by a former female county employee.  The employee charged that she was discharged from her position due to her pregnancy which would have been a sexual discrimination violation.  The EEOC office in Indianapolis has dismissed the claim as it was unable to conclude a violation occurred.  The former employee has until March 17th to file suit based upon the Title VII allegations.
