05/26/11  On Tuesday, May 24th Marshall County Police arrested 27 year old Adam Stewart on charges of reckless homicide and possession of an altered handgun, both Class C felonies and dealing a sawed-off shotgun, a class D felony. 

The Marshall County Prosecutor’s office has decided to press charges against Stewart in connection to the deadly shooting of Stewart’s 18-year-old nephew, Tyler Mattix, at 7 p.m. on February 10, 2011.

Marshall County Detective Neal Wallace conducted the February investigation and in his report stated, “The Marshall County Sheriff’s Department received a report of an accidental shooting at the residence (14384) Nataka Trail.  The victim was flown to Memorial Hospital for injuries sustain in the shooting.  The victim’s uncle Adam Stewart was handling the weapon at the time it discharged causing the injury.  Both the victim and his uncle reside at the residence.  Tyler Mattix died this morning at Memorial Hospital.  The investigation is continuing.  A report will be forwarded to the Marshall County Prosecutor’s Office for review, as is standard for this type of investigation.” 

Adam Steward was taken into custody and lodged in the Marshall County Jail at 9 a.m. on Tuesday, May 24th.  He was released on a $2,000 cash bond at 9:35.  Stewart’s initial hearing will be May 31 in Superior Court 1.
