10/05/12 On Saturday September 29, 2012 at approximately 12:16 AM Marshall County Police Officer Kerry Brouyette was patrolling on US 31 north of Kenilworth Road when he observed a passenger car traveling at a high rate of speed.
Officer Brouyette clocked the vehicle at a speed of 96 MPH in a 60 MPH posted speed zone. Officer Brouyette then attempted to catch the vehicle to initiate a traffic stop when the vehicle accelerated and continued to travel south bound on US 31 failing to stop for Officer Brouyette.
The vehicle continued into Fulton County at which time Fulton County Officers were notified to assist. Once in Fulton County the vehicle then attempted to turn onto County Road 700 North to elude Officer Brouyette, but due to the high rate of speed the vehicle was traveling, the vehicle could not negotiate the turn and went off the roadway and down an embankment. The vehicle then came back up out of the embankment and onto the roadway where Officer Brouyette was able to get the vehicle stopped. The driver was placed into custody without incident.
During the investigation, Fulton County K-9 unit Deputy Travis Heishman was on scene assisting, at which time the K-9 made a positive alert on the vehicle for the presence of narcotics. Officer Brouyette along with Fulton County K-9 unit Deputy Heishman located marijuana and paraphernalia inside the vehicle.
The driver Hayden Kruger, 20, of Elkhart, was transported and lodged into the Marshall County Jail on preliminary charges of: Reckless Driving, Resisting Law Enforcement, Possession of Marijuana, Possession of Marijuana with the intent to distribute, Possession of Paraphernalia, Possession of a Controlled Substance and Minor Consumption. Mr. Kruger received a Bond set at $3,000.00.
Assisting Agencies were Marshall County Reserve Police, Argos Police, and Fulton County Sheriff Department along with Fulton County K-9 Unit.
