Last week a plea agreement was filed in Marshall Superior Court I in the case of Diana Turner. Turner was released from jail at that time. The agreement that must still be approved by the court would have Turner pleading to the charge of neglect of a dependent and receiving a sentence of three years with 90 days to be served and a year of reporting probation.
On May 10 Plymouth Police and EMS were called to the residence of Diana Turner regarding a child that was not breathing normally. The child was taken to Memorial Hospital and subsequently recovered. The child is showing no signs of lasting injury and doing well.
Plymouth Sgt. Gary Cleveland and Detective Sgt. Leo Mangus began an investigation at that time.
According to the probable cause affidavit in the case Turner told her mother that she had placed her hand over the mouth of her one month old child until they had stopped crying. Mangus obtained statements from Turner and her mother on the incident.
At that time she was arrested and taken to the Marshall County Jail.
Also filed in court by the state is a no contact order for Turner pending the sentencing. Under the no contact order Turner may see her child but only in the direct supervision of the Department of Family Services who retains custody of the child.
Tentative sentencing in the case is set for Aug. 7.
