Tanner Arrested for Intimidation

MugShot_David TannerOn Tuesday June 17th at approximately 11:10 P.M. a female made contact with the Marshall County Sheriffs Dept. to report a domestic dispute between her and her husband. The male subject allegedly threatened the female with a firearm in the presence of a child.

Shortly thereafter officers made contact with the male party who admitted to possessing a toy firearm. The male, 46 year old David A. Tanner was then arrested and booked into the Marshall County Jail. He was charged with Intimidation with a deadly weapon. His bond was set at $1,500 and a court date of July 22, 2014 was set for Superior Court #2.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.

    So, I guess clarification is needed on the ‘weapon’. Was it a toy? If so, would that be intimidation with the image of a deadly weapon? If it was a toy I don’t care how angry and threatening you are the only way you could do any damage would be throwing it.

    Are we supposed to believe that the wife didn’t know if he had an actual weapon or not? Did an angry spouse just SWAT her husband? Too many questions from this story will have to wait for the trial.

    If it was a toy I am uncertain why an arrest was made.
