MugShot_Jihad MuhammadAn officer with the Marshall County Police Department preformed a traffic stop on a vehicle for Unsafe Lane Movement Saturday morning just before 1 on US 31 north of 4A Road. During the traffic stop the officer could smell the odor of burnt marijuana coming from inside the vehicle.
An adult female and two male juveniles ages 11 and 14 were in the vehicle at the time of the traffic stop along with the driver, Jihad A. Muhammad from Fort Wayne. An investigation at the scene yielded evidence of recent marijuana use and a baggie of a green leafy substance believed to be marijuana.
The driver, 42 year old Jihad Muhammad, was detained at the scene and failed several field sobriety tests. When asked, he refused to submit to a certified chemical test.
Jihad A. Muhammad was transported to the Marshall County Jail where he was lodged for Operating While Intoxicated- Endangering a class D felony, Possession of marijuana under 30 grams, and Driving While Suspended with a Prior charge. The juveniles were released at the scene to their mother.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
