Neal_HeackThe Marshall County Prosecutor’s Office announced today that the grand jury seated in Marshall Superior Court No. 1 met on September 16, 2014 and returned an indictment for theft as a Class D felony against Neal R. Haeck. The one count indictment alleges Haeck, during the years 2012 and 2013, exerted unauthorized control over the property of Marshall County government consisting of approximately $12,351.41.

The events are alleged to have occurred during Haeck’s tenure as Superintendent of the Marshall County Highway Department. The allegations surround the sale of scrap metal during 2012 and 2013. Haeck is being summoned into court but his initial hearing date has not yet been set.

The Prosecutor’s Office strongly emphasizes that an indictment is only an allegation and Mr. Haeck is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law before a judge or jury of his peers.

Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
