Plymouth Speedway_Tony StewartThe grand jury in upstate New York decided Wednesday that Tony Stewart will not face criminal charges in the racing death of Kevin Ward Jr.’s.
Ontario County District Attorney Michael Tantillo took the case to the grand jury on Monday and after deliverating for the better part of two days found no case for criminal charges.
Toxicology reports revealed that Ward was under the influence of marijuana at a high enough level to impair judgment.
The grand jury had two options to consider, manslaughter in the second degree or criminally negligent homicide. The D.A. said neither received the votes necessary from the grand jury
Stewart still could face a civil suit from Ward’s family.
