MugShot_Tony Clemons Jr07/07/14 On Wednesday, July 2nd in the afternoon officers with the Marshall County Police Department patrol division Officers Bryant, Giordano, McFarland, Cooper with K9 Arras and Sgt. Beam assisted Indiana Parole officers with a home visit for Parolee Tony Clemons. When units arrived on scene no one appeared to be home. Units observed several items in plain view that are conducive to the manufacturing process of Methamphetamine.
MugShot_Brandy GayheartOfficer Bryant then applied for and was granted a search warrant for the property. Officers Bryant and Giordano made entry by force into the residence and located 36 year old Tony Clemons and 21 year old Brandy Gayheart both of who reside in the rear bedroom. Both were then taken into custody for manufacturing, dealing and or delivering methamphetamine.
A search of the property revealed several forms of precursors and active parts of Meth Labs as well as trace amounts of Meth and evidence of dealing. Then Indiana State Police Clandestine Lab team assisted on the scene and took possession of hazardous materials. Officers were also assisted by the Starke County Sheriff’s Department.
On Thursday July 3 a probable cause was filed and Tony L. Clemons’ cash bond was set at $100,000.00 cash. Brandy A. Gayheart’s cash bond was set at $50,000.00.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
