MugShot_Gene McDonaldA traffic stop early Saturday morning ends with a South Bend man being arrested.

Just after 3 a.m. a deputy with the sheriff’s department was traveling west on U.S. 30 near State Road 331.  He clocked an east bound vehicle traveling at 105 m.p.h. He was able to catch up to the vehicle at State Road 19 and US 30 near Etna Green.

During the traffic stop it was discovered that 29 year old Gene C. McDonald of South Bend was driving the vehicle.    Probable cause was found that Mr. McDonald had been operating a vehicle while intoxicated.  At the Marshall County Jail he failed a certified chemical test and was lodged for Operating While Intoxicated.

Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
