ArrestedOn Thursday, May 28, LaPaz police initiated a traffic stop in the parking lot of Burger King.  The vehicle was stopped for an unsafe start, after the officer observed the driver taking off at a high rate of speed, causing items to fall out of the bed of the truck onto Michigan Road.

During the stop, it was found that the driver, 34 year old Michael Gilley of LaPaz, was intoxicated.  After a certified chemical test, he was incarcerated at the Marshall County Jail for OWI Endangering a Person and OWI .15% or Higher and held on a $1,505 cash bond.

 

Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
