SentencingBrittney Patrick, 25, of Plymouth, was sentenced Wednesday (March 18, 2015) in Marshall Superior Court Number 1 to three years imprisonment for possessing methamphetamine, three years imprisonment for the unlawful sale of a precursor, and two years of imprisonment for neglect of a dependent.  The two three year sentences were ordered to run concurrently, and the two year sentence was ordered to run consecutively totally 5 years of imprisonment.  Two years of the sentence calling for imprisonment was suspended, with the balance of the time ordered to be served on probation for one year.

Judge Robert O. Bowen approved an agreement reached between Chief Deputy Prosecuting Attorney Tami Napier and defense attorney Joseph Simanski.  It was agreed the remaining counts were to be dismissed, including conspiracy to manufacture methamphetamine, maintaining a common nuisance and possession of marijuana.

MugShot_Patrick, BrittneyThe case began weeks before Indiana State Police Trooper Jason Faulstich and Keith Bikowski, along with Plymouth Police Officer John Weir obtained a search warrant for a house on Oakhill Avenue in Plymouth.  Executing the search warrant on May 27, 2014 yielded numerous items used in the manufacture of methamphetamine, and a small quantity of methamphetamine.  Subsequent interviews of Ms. Patrick revealed her purchase of various precursors and delivery of them to a co-defendant for the purpose of manufacturing methamphetamine.

Ms. Patrick reported to the court the steps she had taken to address her drug dependence and assured Judge Bowen that she had learned her lesson.  While waiting to be returned to the Marshall County Jail to continue service of her sentence with the Department of Corrections, Ms. Patrick addressed Prosecuting Attorney Nelson Chipman as he was departing the courtroom, and stated, “I promise Mr. Chipman, you will never see me again.”

Chipman responded, “You know Brittney, I have heard that promise many times before.  I wish you well and I hope you mean it and you succeed.”
