Sunday evening about 11:45 County Officer Nick Laffoon observed a vehicle traveling in excess of 90 miles an hour on US 30 west of Tulip Road.  A traffic stop was conducted near the Grovertown Truck Stop and the officer believed the driver, 28 year old John c. Toschlog of Richland MI had been consuming alcohol.

County K9 Officer Brandon Cooper and his partner Arras and Reserve Officer Chad Beatty arrived on the scene.  While Mr. Toschlog was being detained at the scene a plastic bag that contained approximately ¼ pound of suspected marijuana was located in the vehicle.

John Toschlog was transported to the Marshall County Jail where he failed a certified chemical test.  He was lodged in the Marshall County Jail for operating while intoxicated a class A misdemeanor, operating a vehicle with a BAC of .08% of above a class C misdemeanor and possession of marijuana over 30 grams a level 6 felony.

 

 Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
