20 year old Fabian Rubio of Bremen has been lodged in the Marshall County Jail after being charged with sexual misconduct with a minor as a class C felony and rape as a class B felony with a 15 year old minor, to wit he was sentenced to 8 years with 2 suspended.
In May Fabian Rubio was charged with the murder of 15 year old Desi Jones of Bremen. Jones’ partially clothed body was found on 5th Road near Little Egypt by a walker on December 19, 2014. The upper part of her body was charred from a fire.
Dan Butt, Captain with the Marshall County Sheriff’s Department confirmed that Rubio was moved on Wednesday, September 30th to the Kosciusko County Jail as a simple “prisoner exchange.” He said it’s very typical to move prisoners between surrounding jails for various reasons. As part of the exchange there is no need to bill the other jail since they are swapping inmates.
The Marshall County Prosecutor’s Office says a status conference for Fabian Rubio is scheduled for November 19th and his jury trial remains set for February 9, 2016.
