Handcuffs-newFriday evening about 12:15 the Marshall County Sheriff’s Department received several calls in reference to a disturbance at the Tri-Way Drive In at Michigan and 4A Road.

A county officer in the area learned that several of the subjects involved in the disturbance were leaving in a red passenger car.  He observed the suspected vehicle and conducted a traffic stop.  During the stop probable cause was developed that the driver was intoxicated.

The offender, 44 year old Yvonne L. Moffett of South Bend was transported to the Marshall County Jail where she refused to submit to a certified chemical test.  Moffett was lodged in the Marshall County Jail for Operating While Intoxicated with a prior conviction, a level 6 felony.

 

Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
