Crash_US31-9A_5About 12:25 Thursday afternoon April 2nd, the Marshall County Sheriff’s Department received a report of accident at US 31 and 9A Road.  The Sheriff’s Department and Plymouth Fire Department responded to the scene.

 

Crash_US31-9a_7County Police Officer Les McFarland handles the accident investigation and found that 46 year old Kevin Demers of Illinois was driving a 2015 Volvo semi with a fuel tanker.  Demers pulled out into the path of Jerry Secrist, causing the accident.

 

Crash_US31-9A_6Mr. Secrist was traveling southbound on US 31, when the semi pulled out into his path causing the accident.  Jerry Secrist and his passenger, Mary C. Secrist complained of pain at the scene.  Plymouth EMS transported Mr. and Mrs. Secrist to St. Joseph Regional Medical Center in Plymouth for treatment.

 

Crash_US31-9A_8The semi driver, Kevin Demers was issued a traffic citation for Failure to Yield and given a Marshall County Superior II court date of April 28, 2015.  During the investigation, it was found that Demers had an active arrest warrant through Wayne County for Check Deception.   He was arrested and booked into the Marshall County Sheriff’s Department awaiting pickup by Wayne County, Indiana.  The Indiana State Department of Transportation (DOT) was contacted to inspect the semi / trailer for the accident investigation.

 

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed.  They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
