On March 28, 2019, Plymouth Police Officers and Marshall County Sheriff’s Deputies responded to a call of hit and run at the intersection of Michigan Street and Jefferson Street. The caller informed officers someone driving a commercial motor vehicle, a semi-tractor trailer, hit the stop light post on the north-west corner of the intersection and continued driving. Officers responded to the area and found 38 year old Nicole Diallo, New Orleans, Louisiana, operating the commercial rig near the intersection of Jefferson Street and N. Third Street.
Diallo attempted to turn around in the parking lot of LPL Financial while officer’s emergency lights were illuminated stopping the truck. During the turn around, Diallo struck the building with her commercial vehicle and came to rest in the parking lot. Through further investigation it was alleged Diallo struck the stop light in her commercial vehicle while under the influence of alcohol. Upon inspection of the stop light on the north-west corner of Michigan Street and Jefferson Street, officers determined the mounting bracket and post were destroyed.
On Tuesday morning, April 2nd, the Marshall County Prosecutor, charged Diallo through a six (6) count Information alleging one (1) felony, four (4) misdemeanors, and one (1) infraction.The lead count is Obstruction of Justice, a Level 6 Felony, relating to Diallo withholding blood as evidence in the impaired driving investigation. The office of the prosecutor filed additional counts of OWI Endangering a Person, Operating a Vehicle with an ACE of .15 or more, Leaving the Scene of an Accident, Resisting Law Enforcement, and Open Alcoholic Beverage Container. These charges remain pending in the Marshall Superior Court No. 2.
A Probable Cause Affidavit submitted by Officer Jerrid Arnold, Plymouth Police, alleges Diallo’s blood alcohol level was .260 – over three (3) times the legal limit of .08. Diallo was booked into the Marshall County Jail (see booking photograph attached), where she remains lodged subject to posting a bond of $4,500.00.
Readers are reminded criminal charges are mere allegations and criminal defendants, such as Diallo, are presumed innocent until proven guilty beyond a reasonable doubt.
