A teen from North Liberty is in the Marshall County Jail after an accident on Saturday, August 24th.
Just before 8 PM Officer Wozniak with the Marshall County Sheriff’s Department was dispatched to the area of U.S. 6 and Oak Road for a single vehicle accident.
The officer located a yellow 2008 Pontiac passenger car in a ditch with 19 year old Kyle D. Plencner behind the wheel.
Plencner was found to be under the influence of alcohol. He was taken to Plymouth Hospital for a certified test which showed him to be almost three times the legal limit of alcohol.
Kyle Plencner transported to the Marshall County Jail and booked in for operating a vehicle with a BAC of .15 or more, operating a vehicle while intoxicated endangering and minor consumption. He was held on a $3,000 cash bond.
Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
