Kreig_trailerWednesday night the Plymouth Board of Zoning Appeals unanimously denied the request of Landon Krieg to allow a special use for a home-based business at 213 Shalley Drive.

Plymouth Plan Consultant Ralph Booker said a home based business is allowed as a special use in the Traditional Residential zoning district.  He also told members of the BZA that there were a number of considerations they could implement when they consider the request.

Kreig_houseCity Attorney Sean Surrisi said a complaint was filed on the property at 213 Shalley Drive with the city on November 15th.  The complaint does not like the large enclosed trailer and truck that is parked on the street in front of the house.  She also does not like the flatbed trailer parked in the back yard.  Code enforcement checked on the complaint and found that the truck and trailer was properly plated and parked and the flatbed trailer was plated as required.

Landon Krieg told the BZA the dumpster was placed on a cement pad next to the garage for construction debris.  He said the sign in his front yard was removed and that while he has an office, he doesn’t have customers or employees coming to the house.

Kreig_flatbedEight people spoke during the public hearing with the majority being opposed to the special use.  Booker also read seven letters from neighbors who typically commented about the trailers and several mentioned him burning material in a metal barrel on the property.

BZA member, Mark Gidley noted that the property was in a Historical designated district, that the city is trying to protect.  He also noted that the business has been operating illegally at the site for nearly a year and that it basically boils down to respecting your neighbors.  He then made the motion to deny the special use saying that it was injurious to the public welfare. The motion was seconded John Yaden and members Art Jacobs and Keith Wickens also voted in favor of the denial.
