Banks Arrested Following Numerous 911 Calls

arrested_handcuffsOn Sunday, June 28th around 8:45 P.M. Marshall County Central Dispatch received several 911 calls about a vehicle that was stopped in the roadway of U.S. 31 around the north county line. Dispatch had been given further information that a driver was passed out at the wheel. Marshall County Sheriff’s Officer Ayala located the vehicle, checked on the driver who was identified as 44 year old, Anthony Banks of Plymouth. Deputy Ayala then offered Banks Standardized Field Sobriety testing. He was then transported to the hospital where a search warrant was applied for a chemical test. The search warrant was signed by Marshall County Honorable Judge Dean Colvin. Banks was later transported from the hospital to the Marshall County Jail where he was booked held on charges of Habitual Traffic Violator-Lifetime Suspension, Operating a Motor Vehicle While Intoxicated .15% or Higher, Operating a Motor Vehicle While Intoxicated-Endangering, and Possession of Marijuana. Banks was set at $1505.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
