Mug_ Shot richard mitchellOn Tuesday, October 20th at approximately 3:00 A.M. Marshall County Sheriff’s Deputy Bennett responded to a report of an impaired or reckless driver southbound on US 31 from the north county line. Deputy Bennett located the suspected vehicle and conducted a traffic stop in the area of US 31 and 12th Road.
The driver, identified as 47 year old, Richard Mitchell of Kokomo, was found to be under the influence of controlled substances. Deputy Bennett located suspected heroin, methamphetamine, syringes, and drug paraphernalia in the vehicle. During the traffic stop Mitchell attempted to destroy evidence.
Mitchell was taken to the Plymouth Hospital for a certified chemical test and was later transported and booked in the Marshall County Jail where he was held on the charges of Possession of Methamphetamine, Possession of Cocaine or a Narcotic Drug, Unlawful Possession of a Syringe, Obstruction of Justice, Operating a Vehicle While Intoxicated – Endangering a Person, and Possession of Paraphernalia with bond set at $1,505.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
