DUIOn Sunday, July 26th around 9:42 P.M. Marshall County Central Dispatch received a 911 call of intoxicated male causing problems at the Ruperts Resort Campground. When officer Ayala with the Marshall County Sheriff’s Department arrived on scene they located 34 year old Derrick Schmanke of South Bend. Mr. Schmanke was given the opportunity to participate in standardized field sobriety test. He was then transported to the hospital for a chemical test and later taken to the Marshall County Jail where he was held on charges of Operating a Motor Vehicle while intoxicated with a .15% or higher, Disorderly Conduct and Public Intoxication with bond set at $1,505.

 

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
