02/11/11 A Plymouth teenager waived his right to a trial and pleads guilty to conspiracy to commit armed robbery during a hearing in Marshall County Superior Court I this week.
In a plea agreement, 19 year old Anthony Waggoner admitted to robbing the Family Express gas station and convenience store at the intersection of West Jefferson Street and Oak Drive on July 29th last year. About 2:30 a.m. Waggoner walked into the store, pointed a shotgun at the clerk and demanded money and cigarettes. He left the store with $58 in cash and a carton of Marlboro cigarettes.
Mr. Waggoner had a previous conviction for armed robbery of the Pak-A-Sak gas station on West Jefferson Street in 2007. He had been sentenced to 6-years in prison, with time off for good behavior followed by two years of probation. He was still on probation when he committed the crime at Family Express.
The maximum penalty for the Class B felony is 20 years and a $10,000 fine with the minimum being 6 years and a $1 fine. Judge Robert Bowen sentenced the teen to 12 years in prison for the armed robbery. He also suggested Waggoner seek substance abuse counseling while incarcerated.
21 year old Patrick Cruickshank, also of Plymouth drove the get-a-way car and has already been sentenced to 4 years in prison and two years of probation for his role in the crime.
