Criminal Recklessness Charges Filed for Argos Shooting

04/01/14 On Sunday, March 30th at approximately 7:23 P.M. Officers from the Argos Police Department, the Marshall County Sheriff’s Department and the Indiana State Police responded to the Argos McDonald’s and BP gas station in reference to a shot fired.  Arriving at the location 21 year old David J Boston of Hope, Indiana was eventually taken into custody for a charge of Criminal Recklessness with a deadly weapon, and creating a substantial risk of bodily injury.

It is alleged that Mr. Boston was in the men’s restroom when a 9mm handgun he allegedly possessed accidentally discharged.  The bullet traveled through the walls of the men’s bathroom and through the wall of the women’s restroom, and eventually lodged in a beam in the common area of the BP gas station and the MacDonald’s restaurant.  No one was injured, although there were persons in the women’s restroom at the time.

Mr. Boston was transported and lodged at the Marshall County Jail and held on a $1,505 bond.  Readers are reminded that this is merely an allegation and all persons charged with a criminal offense are presumed innocent unless or until proven differently in a court of law.
