M.C. Prosecutor’s Office Looking for 2 Drug Defendants

04/17/12 Marshall County Prosecuting Attorney David R. Holmes requests the public’s help in locating two individuals charged with serious drug offenses that failed to appear in court as promised.

   Julio Cesar Torres Cruz and Lizeth Faviola Martinez Arroyo were each charged alleging three Class A felonies of Dealing in Cocaine having a weight of greater than three grams, specifically 76.83 grams; Dealing in Cocaine within 1000 feet of the Bremen Public Schools; and Possession of Cocaine within 1000 feet of the Bremen Public Schools.  The offenses were alleged to have occurred on July 13, 2011.

  Cruz was previously released from custody after posting $20,000 in cash as bond; and Ms. Arroyo was released from custody after posting $10,000 in cash as bond.  Both defendants were scheduled to appear in court this past Thursday, April 12, 2012 to plead guilty based on negotiated agreements.  Both of their attorneys reported to the court they were confident their clients knew precisely the court date and time.

When it was evident the defendants were not going to appear for court, Chief Deputy Prosecutor E. Nelson Chipman, Jr. requested forfeiture of the $30,000 put up for bond, and the issuance of warrants for the defendants’ arrest.  Judge Pro-Tem Derek Jones granted the prosecutor’s request and the bond was forfeited and warrants for their arrest issued.

In addition, the defendants’ names were placed on the IDACS/NCIC system (the Indiana Data and Communications System interface with the National Crime Information Center computer) to alert law enforcement in all 50 states that the Prosecutor’s Office will seek extradition if and when the defendants are apprehended.
